Perry Lucas, 28, was sentenced Jan. 13, 2011, to 20 years in prison plus 10 years of extended supervision for fatally shooting Detarius Martin, 23, and wounding Martin's brother during a breakup dispute in Fitchburg, Wisconsin.

Fitchburg police responded just before midnight on June 16, 2009, to an apartment building on Leopold Way, where Detarius Martin lay dying on a strip of grass between the parking lot and the building. Police said he had been shot twice in the back as he fled down a hallway with a group of friends. His older brother, Chukarius Martin, 27, a combat veteran of Iraq and Afghanistan, was shot once in the arm and survived.

Officers arrested Lucas minutes later after he called 911 twice to report that he had shot a man, Fitchburg police Lt. Todd Stetzer said.

The shooting followed a chaotic confrontation inside the building. Lucas' live-in girlfriend, Danyelle Dalbec, had recently broken up with him and arrived at the building sobbing, saying Lucas was cheating on her at that moment with another woman in their apartment, according to Detarius Martin's girlfriend, Sharmarisa Hammonds. Hammonds and the Martin brothers accompanied Dalbec back to the apartment so she could confront Lucas and collect her belongings.

A fight broke out between Dalbec and the other woman, and the group was pulled into the hallway by the Martin brothers as they headed for a stairwell, police said. Lucas then reappeared and fired four or five rounds from a 9 mm handgun, according to the criminal complaint. Lucas told the 911 dispatcher that a man had charged at him, but Stetzer said ballistics evidence and other findings from the shooting scene were inconsistent with that account.

Lucas, an Army mechanic who served in Iraq, was charged with first-degree intentional homicide and first-degree reckless endangerment. A jury convicted him in October 2010 of second-degree intentional homicide and reckless endangerment after his attorney argued he suffered from a disorder connected to his military service.

Dane County Circuit Judge Nicholas McNamara called the shooting "needless" at sentencing. Bessie Martin, the victims' mother, told the court in a victim impact statement that "the maximum sentence would have been better." Lucas apologized to the Martin family before sentencing, and his attorney, who had argued for leniency citing his military service, said she planned to appeal, calling the term "a very severe sentence."
