The man accused of a downtown Orlando shooting rampage will go on trial almost four years later.
A status hearing was held for the case against Jason Rodriguez on Friday morning. It was decided that Rodriguez will stand trial in November.
However, the date could change depending on Rodriguez' mental state and treatment requirements. Earlier this week, Rodriguez was found competent to stand trial.
He is accused of opening fire in 2009 inside the Gateway Center, where he used to work. Otis Beckford was killed and five others were hurt.
Attorneys and Judge Belvin Perry spoke about whether Rodriguez could slip back into a state of incompetency.
"Two weeks in the Orange County jail; doesn't take a Rhodes Scholar to figure out what may happen," Perry said.
Chief Assistant State Attorney Linda Drane Burdick will prosecute the case.
Burdick said she does not think Rodriguez should be transported daily from Gainesville for the trial.
"My recollection is he does not like the means of transport in the back of a van and he's claustrophobic," Burdick said.
Attorneys said they will work to find a secure hospital closer to the Orange County Courthouse while he stands trial.
Defense attorneys claim Rodriguez was insane and paranoid at the time of the shootings.
Rodriguez has a long history of mental illness and has been held at state hospitals since the shootings. He is charged with first-degree murder and faces multiple charges of attempted murder.
