think you missed something, let me explain.
the car on the left (the one that got rear ended and is in what you say "the overtaking lane" is not at fault). the car that hit him is at fault for several reasons....
1.you must be able to control your car no matter what, period.
2.he is speeding like a mother fucker!
3.he is being chased by the police and is trying to evade them.
it is not I REPEAT NOT THE CAR ON THE LEFT FAULT.
