Looks like a scooter to me, but some are considered motorcycles like a Honda wave runner. He had brain trauma.

From the look of it I bet the gal in the green shorts is no longer with us.  Helmet would have helped.

Even if the scooter had right of way they should have slowed more due to the traffic in that intersection.
