i think he was taking evasive action not over taking.
you can see flashing blue lights up ahead an the car in front seems to slow down.

i think they were both speeding and the first one suddenly slowed down when he saw a cop car, the second one saw it too late and had to take evasive action causing him to crash...

or that's just a guess
