I don't see why that other pedestrian was blaming the driver. Maybe it was an extortion attemp and they were in kahoots.

Looks staged. Even if it wasn't, the pedestrian was uninjured enough to kick the car's headlight quite soundly. And he isn't likely to win any damages in court for the injury he received from kicking the car.
