The tines of the forklift actually are not the visible looking at the from the side. If he didn't identify the vehicle as a forklift be might not have known there were skinny tines sticking out of the front.

Two problems here... Biker should have slowed down, scratch that -- stopped. If the forklift had been a car the biker would have stopped until the way was clear. After all, the forklift was sideways in the biker's lane. Second... the forklift driver should have had his forks all the way down until he was next to the truck, then raised them. You do not drive a PIV forward with raised forks...ever!
