For sure. While pedestrians may have the right of way, you can't assume people are going to respect that or pay attention. You can be dead right, emphasis on the dead. At the speed the driver was going, very little to no time to react anyway. I would assume excessive given the presence of multiple crosswalks.

That scooter was going twice the speed of a ped. That brings a new set of problems to the table: Drivers approaching a crosswalk and seeing that nobody is in walking distance of the road.
