BMW S1000R Rider Doing an Educational Video Slams into Car Doing Wrong Overtake
Colombia. A biker with social media name, biker_raf12, was recording a promotional educational video demonstrating how to properly lean into a curve. He did not cross the lane marker or lose control of the motorcycle. He simply rounded the bend and instantly struck the car, which had unexpectedly swerved into his lane. The motorist was entirely at fault for executing an illegal overtake on a double yellow line. The driver of the Renault Clio was not immediately placed under formal arrest at the scene. The National Police Highway Patrol and localtransit prosecutors have opened a criminal investigation against the driver for negligent injury and severe traffic violations, incl. executing a forbidden maneuver across a double yellow line on a curve. The rider survived the initial impact but remains hospitalized in critical condition at a high-complexity trauma center in Bogotá. He sustained severe polytrauma, including deep head trauma and multiple fractures to his extremities. The driver and passengers of the Renault Clio suffered minor cuts and bruises from air-bag deployment and broken glass but did not require critical emergency hospitalization. Under Article 120 of the Colombian Penal Code, because the driver caused severe polytrauma through a prohibited action (illegal passing on a double yellow line), they face a criminal prosecution. If convicted, penalties can range from monetary fines to prison sentences of up to 36 months, depending on the definitive disability timeline certified by medical investigators for the biker. The driver was issued a D02 traffic citation under the Colombian National Traffic Code for overtaking another vehicle in a banned zone (double yellow line / curve). This specific category "D" violation carries a mandatory fine of 30 legal daily minimum wages (SMLDV), totaling approximately $1,300,000 COP. Transit authorities have initiated administrative procedures to suspend the driver's license, which can span from 6 months to 1 year for reckless maneuvers causing a severe crash. The obligatory third-party traffic insurance (SOAT) of both vehicles was immediately activated to cover the primary emergency medical expenses and initial ICU stabilization costs for the biker. Civil attorneys representing the injured motorcyclist ("biker_raf12") are initiating a civil liability claim against the driver and vehicle owner to seek full financial restitution for long-term rehabilitation, bike total-loss damages, and lost wages. |
