Now here we go.... I shall start it: Who's at fault? Answer: BOTH the biker and the mother pedestrian. Why?: Reason#1 Why the pedestrian is at fault: Well you can see that the lights started to change, so it's hard to tell, but initially, the pedestrians were walking in to traffic and did NOT have the right of way. -BUT- That fact is irrelevant when determining actual fault. Reason#2 Why pedestrian is at fault: You are the decision maker for your baby and the ultimate protector. So regardless of whether or not you have the legal right of way, your baby is dead either way. You could have protected your child by paying better attention. Let's assume that the pedestrian DID have the right of way, well you still walked you baby infront of a vehicle because you were daydreaming or talking about Twilight saga bullshit or something. You are partially to blame at least. Reason #1 why biker is at fault: OBVIOUSLY, the light was changing and the biker still went through it anyway and if he was paying attention he should have been able to avoid the pedestrian's stroller. Whenever these situations happen, most people tend to focus on who had the LEGAL right of way. But in reality, that is totally irrelevant when you are talking about neglect. A pedestrian is aware that drivers are idiots (presumably). A driver could be drunk, high, insane, sleeping, texting, masterbating, plucking eyebrows, or whatever. To rely on the fact that the lights told you it was safe to 'walk' means you didn't account for the random stupidity of drivers in general. To forget this places some responsibility on you. |

Doesn't look like he hurt the kid though. looks like he just hit the handle and knocked it over, and the low speed. Very lucky situation, if no harm was done. I wonder if the guy was beaten to death by a mob, and is posted somewhere else in the vid section.  |

what do you mean go back? he never went to driving school. most asian motorcycle drivers are either self taught or taught by friends and neighbors. driving schools charges too much for too little lessons so not too many wants to enroll. sad to say, even philippine public transport drivers, most of them were just taught by friends and doesnt even know how to interpret roadsigns.
