A fatal road accident is the reason for the initiation of a criminal case. The Investigative Committee of the Russian Federation for the Nizhny Novgorod Region today announced they have opened a criminal case on the provision of services that do not meet safety requirements, which inadvertently entailed the death of two persons (part 3 of article 238 of the Criminal Code of the Russian Federation)

One of the passengers died on the spot and the second died in the hospital. Four more people were injured. Three received minor injuries and a fourth is now in intensive care after surgery.

According to the investigation, on February 20, 2021, in the early morning a traffic accident occurred, as a result of which two people died.

The motor road on which the accident occurred is included in the list of local roads of the city of Nizhny Novgorod. At the time of the road traffic accident, a snow run (compacted snow cover in the form of a track) was detected on the road surface.

Investigators of the Investigative Committee believe that one of the reasons for the accident was the presence of ice on the road due to the improper fulfillment of the obligation to maintain highways on the territory of the Prioksky district of the city of Nizhny Novgorod.

In accordance with the requirements of the legislation for the specified category of motor roads, the presence of snow and winter slipperiness is not allowed on the surface of the carriageway after the completion of work to remove them within 5 hours. The specified requirements for the maintenance of this road and ensuring traffic safety on it were not met.

In the course of the investigation of the criminal case, the investigators of the Investigative Committee will give a legal assessment of the actions of the employees of the subcontractor who carried out snow removal work on the road that did not meet safety requirements.
