2 Girls on Scooter Facing Lawsuit After Helping Old Woman Falling from Bicycle

On February 19, 2026, two middle school girls stopped to help an elderly woman in China who had fallen off her bicycle while navigating a turn.

Local traffic police determined the students held "secondary responsibility" for the accident. The reasoning was a "non-contact accident".

The police claim the students' electric scooter did not yield properly, causing the woman to panic, brake suddenly and fall.

While the woman's actual medical bills were approximately 26,700 yuan, her family filed a lawsuit seeking 224,000 yuan in total compensation for medical costs, nursing care and emotional distress. Court decision will be held on Feb. 26.

One of the students reported that her daughter is now traumatized and afraid to help others or even attend school.

Critics argue that such rulings undermine the Civil Code of the People's Republic of China, which includes "Good Samaritan" clauses intended to protect those who provide emergency assistance.

Personally I’d hold the old lady at fault for not knowing how to brake properly when facing traffic. She’s too old or frail to be riding a bicycle.

Any such critics would be stupid because they are not being sued because they helped, they are being sued because they have some responsibility in causing the accident.

The trial, originally scheduled for February 26th, has now been halted as the plaintiff has withdrawn the lawsuit.

The elderly woman claimed she was startled and fell which is correct imo but her pedals were not moving and by the looks of it's a road slope. She failed to give way or even attempt to brake approaching an intersection where it's impossible to see if traffic is coming from the right. Think she could have just slam the brakes and put her left foot next to her bicycle to keep balance. she's just clumsy and prolly has no clue what she was doing.

According to a news report on Saturday, a reporter contacted Ms. Zheng, the mother of the girl involved in the incident. Ms. Zheng stated that the matter has been properly resolved, the plaintiff has withdrawn the lawsuit, and the related content previously posted on Douyin and WeChat moments has been deleted, as she does not wish to occupy public resources any further.
