It looks like, at least one of the Good Samaritans, the black suit, exited the crashed car!
Also, why would the passengers be arrested?
They could claim, that thru their drunken haze, they believed the driver was sober to drive them.
I have watched a few court cases/investigation reports of fatal DUI related crashes, victim being someone not in the vehicle. While the drivers are arrested. The passengers are questioned.
