Legally, I think the shooter may be able to argue that he feared for his life, that while incapacitated with mace the other guys could have beaten him to death (an already tense situation) or taken his gun and shot him. Not the strongest self-defense argument but it's there. The more determinate question is who initiated the physical confrontation, because in most states you can't claim self-defense if you were the instigator. Did the dead guy approach the shooter aggressively enough to be considered "initiating the physical conflict" or was it the shooter's physical push that was the first contact, which led the other guy to use his mace? IMO he's double fucked.  |

I wonder if the Pinkerton Agency made a statement about this? How did they even get pulled into this in the first place? Knowing how sneaky and crafty they've been in the past, and how long they've had to practice, I can imagine no better outfit to serve as a sort of agency for Provocateurs. |
