in the first the driver is clearly not in the car anymore, so somebody helped. I don´t want to be in his shoes if he caused the crash and killed everyone else in the car.

Just because the driver survived the crash doesn't mean he's alive today. Those sound like agonizal last breaths.

If I were almost dead, mangled in my car gurgling blood the last thing I'd want to see is a horde of people shoving cellphones in my face.
