well it looks like he was in the lane merging right but changed his mind last second. he veers over what looks like the median lines. she could have assumed he's going the other way and went ahead. mixed with his speed and last second switch, it was a recipe for disaster.

This is absolutely he driver’s fault for first, his/her speed and second, the fact that (s)he changed lanes right at the last minute. There was nothing the scooter driver could do. Even if the scooter was going straight ahead instead of to the side, the car still would have likely hit her.

Also, I really think nothing will happen to the driver in this situation. I, personally, remember a guy I met in Laos who took me out on the town on the first night I arrived. He was driving JUST like the individual in this video and I told him to slow since he might hit someone. He said, “Don’t worry. I’ll just give them some money and they’ll be ok with it.” He, then, went on to explain that this happens often and paying the family directly settles things. About $3-400 usually suffices. I know it happens in first world countries too, so I can’t talk much, but it still surprised me to hear speak of it so nonchalantly.
