Re: The Son Who Killed His Father by Attacking Him with a Stone
A long-standing property dispute regarding a house in Bharathi Nagar. There was also tension because a court had ordered Rajasekar to pay his father a monthly maintenance fee of ₹3,000, which he had failed to do. The investigation shows the dispute dating back to 2017 when the father transferred his house in Bharathi Nagar to Rajasekar. Due to financial hardship, the father later sought to reclaim the property through the RDO Court. In 2024, the Madras High Court ordered Rajasekar to pay his father a monthly maintenance fee of ₹5,000. Rajasekar’s failure to pay led to a further appeal by the father, with a hearing that was scheduled for the second week of March 2026. The father's daughter, Jayamani, informed police that Rajasekar had explicitly threatened to kill his father just days before the incident after receiving the latest court notice but like usual the Police waited for an actual crime to be committed before taking action. Rajasekar is charged under Section 103(1) of the Bharatiya Nyaya Sanhita. A conviction for murder carries a mandatory sentence of either life imprisonment or the death penalty, along with a fine. Because the murder was filmed by a bystander, the prosecution has direct evidence. This makes it much harder for the defense to argue innocence and often leads to faster trials. The fact that Rajasekar intercepted his father on Othimalai Road after a court summons suggests premeditation, which typically leads the court to lean toward stricter sentencing. The property was originally owned by the father but was settled in Rajasekar's name in 2017 on the condition that he should care for his parents. Because Rajasekar allegedly failed to provide care, the father filed a petition under the Maintenance and Welfare of Parents and Senior Citizens Act to cancel the settlement and reclaim the house. With the father deceased and the son in prison, the property will likely become the subject of a civil suit by the father’s daughter, Jayamani, to revoke the original transfer due to the criminal act. |
