After collapse of Soviet union mafia formed almost in all former Soviet union countries. There are many cases when guys had to kill other fellas because it was the only given option to stay alive. Sometimes they had to kill their friends or relatives. If they refused mafia killed both.

This is one of those rare situations where being from Russia is a good thing. In common law countries (i.e., US, UK, etc.), it is true that you can not use a duress defense for killing someone under coercion, because purposefully killing an innocent person under any and all circumstances is considered an immoral act. You simply don't have any legal standing to choose your own life over someone else's. Now, you may get a very, very light sentence, but you're still going to be a convicted murderer. At its core, this is really the case because it is a very old foundational legal concept, from a period in history where criminal law had a general attitude of "Well, we're gonna hang you either way. If God wants to let it slide, that's his business" In Russia, though, duress is specifically laid out as a valid defense for murder, because it has to be, because in Russia this shit actually happens. |
