My dad was an adult probation officer after retiring from the military. One of his probationers got in trouble one time and it took 8 police officers to subdue him and put him in the squad car- you never know just what someone is capable of. While in the military, my dad personally witnessed a man shot 4 times, all shots in vitals(1 heart, both lungs and the abdomen) at point blank range with a .357- b4 the guy died, he KILLED the guy who shot him with his bare hands. When subduing a suspect, whether by taser, gun, baton, whatever, you continue UNTIL the suspect has STOPPED resisting or is completely incapacitated. This is why you DO NOT resist, you are just ASKING to get seriously hurt. An LE officers job, 1st and foremost, is to go home to his loved ones at the end of his shift. Period.

Corp. Benjamin Robinson is the RCMP officer who failed a breathalyzer test after being involved in a fatal collision in Tsawwassen,B.C. on Saturday night,CTV has learned. Robinson was one of four officers who were also involved in a high profile Taser incident that led to the death of a Polish immigrant at Vancouver airport last year.

Robinson was off-duty and allegedly driving a jeep when it collided with a motorcyle driven by 21-year-old Tsawwassen resident Orion Hutchinson. Hutchinson died at the scene. A police statement said the RCMP officer later failed a breathalyzer test.

The RCMP officer was released on a promise that he will attend Surrey Provincial Court in January 2009. He will face charges of impaired driving and causing death.

A police statement said Hutchinson was thrown from his bike when it collided with a Jeep driven by the RCMP officer at an intersection on Saturday night. He was pronounced dead at the scene,police said.

RCMP Sgt. Tim Shields has told reporters that the officer involved in the collision on Saturday was one of the four police officers who were involved the Taser incident that led to the death of Polish immigrant Robert Dziekanski.

“Dziekanski arrived at Vancouver International Airport as a would-be immigrant about 3:30 p.m. on Saturday Oct. 13.07. Between the primary customs post and the secondary checkpoint,he went missing.

He apparently sat forlornly near the baggage carousel not understanding what he should do or where he should go until about 10:30 when he finally found his way to the second customs post.

After this second interview with border officers he was cleared to enter Canada,but remained in the secure arrivals area until about 1:15 a.m. when Dziekanski became agitated and starting throwing around objects.”

Mr. Dziekanski died on Oct. 14.07 after an RCMP officer shocked him with a Taser at Vancouver Airport. A Victoria man captured the death on video.

The incident has had significant coverage in Poland. The Polish consul general demanded answers about Dziekański’s death.[47] Canada's ambassador in Poland was invited to discuss the incident with officials in Warsaw, and one Polish official stated in the weeks after the incident that "we want the matter clarified and we want those guilty named and punished."[9]

On December 12, 2008, the Polish embassy in Ottawa issued a statement stating that the Crown's decision not to charge the RCMP officers was "most disappointing".[53]

In February 2009, it was reported that Canada had unilaterally suspended its mutual legal assistance treaty with Poland,[54] thus blocking Poland's own investigation of the Dziekański Taser incident.[55][56]

Canada's Public Safety Minister, Stockwell Day, said that he has asked the RCMP for a review on Taser use and that a report is being prepared, and pointed out that several investigations of the incident are already underway. Liberal Public Safety Critic Ujjal Dosanjh said that what was needed was an independent body to conduct a national and public review of the issue, which would lead to national guidelines for Taser use by law enforcement officers.[57] BC NDP Public Safety Critic and Port Coquitlam MLA Mike Farnworth called for a special prosecutor to be appointed to investigate the incident, citing concerns of police investigating themselves.[58]

Closing of investigations in Poland[edit]
Ministry of Justice of the Republic of Poland Prosecution Service in Gliwice launched their own investigation while assisting Canadian police visiting Poland as part of the Canadian investigation. Polish criminal code allows for the pursuit of foreign nationals suspected of committing crime against the Polish citizens abroad; which could lead to an extradition request.[85] The Prosecution Office forwarded a request for assistance from Canada. The request for documents from the Canadian investigation was denied with the rationale that forwarding them is not in the best interest of that country. Under the circumstances, in December 2011 the Polish investigation was terminated.[86]
