Will be interesting to see how this plays out. Use of force to defend yourself has to be "reasonable". Example: Marine decided to punch the guy instead of choking. One punch to deck the guy, then stopping is self-defense. Jumping on top of the guy unconcious on the ground and pounding his head 15 more times can likely be argued this was not necessary. One punch did the trick.

For a charge of 2nd-degree manslaughter, it is necessary to prove that the individual acted recklessly. In layman's terms, recklessness means having a reasonable understanding that one's actions may result in death. As somebody who has done Jiu Jitsu on and off for almost 20 years. I would have to side with the prosecutors that he acted recklessly. While at the same time, if I was the judge who passed down the sentencing, I would give him the minimum charge of one year. This same situation happened to a man named Cameron Poe back in the 90's. He was a US Ranger who punched an aggressor during an altercation outside a bar. The aggressor hit his head on the concrete and died. He got seven years!! Unfortunate situation for all party's, it's a shame the media is making such a huge show of it. |

If you choke someone until they stop moving I don't know what else you would expect other than getting charged. The NY prison system isn't going to be nice for this guy, gonna have to PC up like a sex offender lol

You’re right, it’s should NOT be this way. But it NEEDS to be this way. Bleeding heart liberal policies created this useless bum, then promoted his useless existence, and now dragging his death through more shame as a LOT more negative info will be revealed about this dead bum. The only thing that will clear the subways of this annoyance is extreme deterrence. If every useless, mentally Ill bum would threaten like this one did, more can be slowly choked out on the subway. Hopefully not to death, however. Being humbled to unconscious tends to calm behavior. Please, please, please quit painting this fool as the victim. Doing so only guarantees & promotes more jerks using ‘metal illness’ as a reason to harass and threaten people. Chicago has this issue as well. Choke em out in the Windy City, they’ll wake up. Drown them in liberal tears and their corpses reek prior to their slow, sad, drug addicted death on the street. |
