If you're a law enforcement officer, you put yourself wherever you deem necessary or safe. Ok, approach from the front, then move behind window, that simple. He didn't have the drop on her, you can see she is plainly standing in front of the window letting him hand documents to her that she accepts. She didn't think she was in any danger at all, and that was the problem. He didn't get the drop on her, she didn't do the right thing, SHE let her guard down!
