The numbers are staggering: in 1995, 1,400 immigrants were subject to nonjudicial removals, representing 3 percent of total deportations. By FY 2012 that number had sharply increased to 313,000 nonjudicial removals – an all-time high.

Under today's removal system, only one quarter of all people facing expulsion get to present their case before an immigration judge. These judges, employed by the Justice Department, are experts in immigration law. They conduct formal court hearings where they hear live witnesses, review documentary evidence, and evaluate applications for immigration relief.

By contrast, nonjudicial removals are fast-track proceedings wholly controlled by the Department of Homeland Security ("DHS"), sometimes involving only a single border agent who acts as both judge and jury. Those facing nonjudicial removal have no lawyer and no chance to appeal.

People did protest deportations during the Obama administration, including deportations of people without criminal records. There were sustained immigrant rights protests around 2013 to 2015, family separation cases, workplace raids, and criticism of Obama as the "Deporter in Chief". So the idea that no one objected back then is not accurate. They did, but those protests were more diffuse and largely focused on policy harm rather than specific violent incidents.

What is different now is not simply that non criminals are being deported. That has happened under multiple administrations. The difference is the context and method. Current enforcement has been publicly framed as targeting "rapists, murderers, and drug dealers", yet large scale operations have swept up many people with no criminal record and even U.S. citizens. That disconnect between stated intent and actual outcomes is a major driver of outrage.

More importantly, today’s protests are being catalyzed by lethal force. During the Obama years, protests focused on deportation policy and humanitarian consequences. Today, protests are reacting to federal agents killing civilians, including citizens, and operating armed in public protest spaces. Deaths fundamentally change the nature of public response.

Minnesota became a flashpoint because several high profile incidents occurred there in a short period of time, making the issue immediate, visible, and emotionally charged rather than abstract or statistical.
