According to the update in my post above yours, the gunman was the victim's uncle. He probably didn't think he was actually going to be shot. If the news article is correct, the bloke deserved that bullet.

If you are a rapist you deserve to be shot in the head point blank by your uncle on the sidewalk as you leave a store.
