Many years ago here on DR there was a video of a an angry man going into a hair salon to kill his ex-girlfriend. Rather than acting contrite and and backing away and pleading for mercy, the woman stood there with her hands on her hips, lips pursed, almost daring the man to shoot her as he brandished his pistol. Well, he did. And it knocked that smirk off her face real fast.

The deal is, if someone has a gun pointed at you, don't assume you have an immunity to lead.

Threatening to kill them and then raising the bat isn't the wisest thing to do with two guys holding guns. I read that after the first shots he threw the bat and more shots were fired that killed him.
After that throwing point the threat was over as he was unarmed so that's going to be the tricky point in trial i guess.

Aaron Howard’s wife/girlfriend, Kara Box, recorded the incident on her cellphone and Detective Jordan Brown reviewed this video. He believes it is apparent from the video, combined with the interviews of the Millers, that they were tired of their neighbor, Aaron Howard, acting out and yelling and threatening them verbally. They brought out firearms during this argument and both Millers stood in the alley as Aaron Howard got more and more upset. As soon as he raised the bat while approximately seven or more feet away from John, John shot him.

the orange shirt guy probably got in too close for the older guy to fire two shots at him. throwing the bat showed he was still a threat and he got headshot as a result.

will be an interesting trial though it’s clear the orange shirt guy was the aggressor judging by the conversation.
