Re: Man Fatally Shot During Dispute In Texas

Considering that the decedent stated he was going to take the weapon and use it against the guy, I think it actually will be classified as justifiable self defense.

Though as I stated in my post a few hours ago, it was still incredibly irresponsible firearm usage, even if it followed the letter of the law.
I’m a gun nut I own multiple guns love shooting shit up. family feud on my porch I’m coming out with my bare hands, if physical confrontation really is necessary, leaving my guns in the safe. I plink, I’m a non violent person, not looking to shoot anyone up. case burglars came a-knockin' that'd be a different story yessir.

so me and you license-plate friend would tend to be in agreement

I doubt he'll be successful in claiming self-defense on that one.

Re: Man Fatally Shot During Dispute In Texas

looks a little bit unjustified...yes the guy grabbed the gun, but then fell backwards away, THEN the guy opened fire...probably gonna get locked up

He might get off. I knew dude was dead as soon as he hit the ground. I like how they continued arguing as if dude wasn't dead on the ground. I kinda feel for dude that got killed. Women be on that bullshit.

Re: Man Fatally Shot During Dispute In Texas

If this happened anywhere other than Texas. Because it was in Lubbock though and dude was on that guys property... in his face talking reckless. Texas castle law is a thing and you CAN be shot and killed on sight simply for trespassing on some one else's property.
Still sad because it didn't need to happen :(
Killed “on sight” simply for trespassing?

I’d like to read that law.

Cop: why did you shoot him?
Guy: he was in my front yard
Cop: he was picking up the frisbee his kid threw
Guy: yeah, but he was on my front lawn and I saw him

A straight up “shoot on sight” defense with no other reason for the shooting would be a one way ticket to the slammer.

Just walking onto someone's property isn't trespassing, so you aren't free to shoot kids for retrieving frisbees out of your yard. Now if they had to jump a fence that's different. But it's not considered trespassing unless they've been told to leave and don't or if they've been told not to enter and enter anyway, hence the "Posted No Trespassing" signs you see everywhere in Texas

A straight up “shoot on sight” defense with no other reason for the shooting would be a one way ticket to the slammer.
