I understand that but his lawyer will argue that the human cells (dead skin, hairs, liquid, or whatever they use to extract DNA) was already all over the apartment before the crime. It is not like a crime scene in a forest where you have a hard time explaining your DNA found on a dead body. Totally different story when it happened in your apartment.
