~ Everyone walking in or already in that store walking around like they alone are the God of Pride in hell. ~ At first I thought it was gonna be between the guy at the counter being oomphed by the pushy customer behind him who can't wait to get done & out. ~ But then, looks like the two involved knew they were gonna meet again sometime, since they both probably live nearby & have to go to the same store to shop. But one knew he couldn't just win from fighting alone, so he came prepared, with a gun. ~ Lesson learned & earned: Don't bring words of wisdom or fists of fury to a gunfight.   |

Not from what we can see on the video. The initial attacker was already backing off before the shooter completed his draw. He was even motioning for the shooter to come at him (before he saw the gun), which implies that the initiative was under the shooter's control. Unless there was something off camera that indicated a serious threat, brandishing the firearm is about as far as could be justified in most jurisdictions, and from the first attackers response, it would have been enough. When he pulled the trigger, it was almost certainly excessive force. |
