Brazil, Saturday (11/08/2014). A lawyer in a pick-up truck that caused the crash that killed a young publicist, 29, told police he ingested alcoholic beverages minutes before the accident.

The mother of the victim told: "He was a brilliant person, a humble guy, worker and good son. A person who had no enemies and he never hurt someone. We are all shocked by the way it happened and the way he died "she said.

The victim's sister was planning a birthday party for herself on the 30th of November. "First i did not want to throw a party because we had lost our maternal grandmother, who died two months ago in Sao Paulo. But their mother, who took care of her and still was in Sao Paulo told she would come over to help with the preparations for the birthday party in Salvador as they hadn't seen eachother since the funeral, and the mother said that the party should be a moment of joy.

The victim returned to Salvador two weeks ago, after serving in political campaigns in the country and was taking advantage of these days to rest before returning to work.

According to her, the young man worked in major advertising companies in Salvador. "He had a good career. He was always called to work and often out of state and won 3 awards. He also spoke of launching new professional projects that he wanted to put into practice"

The sister said: "While we are shaken, we want the responsible be punished. We know he has been involved in other accidents for being drunk behind the wheel"

The delegate, at the 16th Precinct, investigating the case, said on Monday (10) that the lawyer denied being responsible for the collision, although he confessed that he drank before the accident.

"He said that a car hit him and, because of that, he lost control of his Toyota Hilux and hit the victim's car," said the delegate but according to CCTV the truck hit the side of the vehicle driven by the victim, who then flipped over. His car was completely destroyed.

The lawyer has been detained in special cell. According to the delegate, he has been caught driving under the effect of alcohol on another occasion, after having caused an accident, and also has been involved in a fight widespread in Bahia.

Because he isn't a first-time offender, justice denied bail. The delegate has ten days to complete the survey and send the case to the Public Ministry.

A medical nurse, 34, who was with the victim in the car when the accident occurred, was transferred to the General State Hospital. She is in a coma.

The victim suffered multiple traumas, had to undergo surgical procedures and is with stable vital signs.

The police investigation into the death of the publicist in November 2014 was completed in the first week of September, and released by the victim's lawyers and the suspect on Wednesday (16) in Salvador.

The result of the investigation shows that the suspect, a lawyer and university professor, committed murder against the publicist and aggravated battery against the nurse.

Investigation showed that the lawyer drove 140 km/ph on a road with a max limit of 70 km/ph. The defender of the victim also said the suspect declined to take a breathalyzer test on the day of the accident on the grounds of not producing evidence against himself.
The nurse still suffers from cognitive sequelae of head injury and is still recovering.

The lawyer of the accused disputes that the evidence indicates the client's drunkenness. "These tests have to be discussed in court. If he refused to take the test or not they have no evidence that he drank no matter what he told after his arrest"he says.

He argues that there are many aspects of the process may influence the decision of the prosecutor on the case. "The autopsy report showed alcohol in the body of the victim, "he says. "And the victim run a redlight" he added.

I think the victim misjudged the speed of the pick up driver. That guy was hauling ass. When he came to the intersection, he did initially stop then figuring that no one was coming, thought it was okay to turn. He would have been alright if the other driver wasn't going twice the speed limit.

Lawyer admitted drinking before the incident and video evidence clearly shows him driving faster than the posted speed limit. To top things off, he lied about being hit by another car which caused him to crash into the victim's car. Further, the lawyer has been previously involved in other incidents.

No matter what other evidence is included, the lawyer is - at the minimum - guilty for vehicular manslaughter and should be charged and sentenced accordingly. His career is over.
