Two weeks after a major shakeup at Kings County Hospital's troubled psychiatric ward last year - in the wake of a coverup scandal - workers tried to hide yet another mishap.

This time, state probers found records showing Kings County psych staff claimed a patient was resting in a "calm" manner. In fact, the patient was attacking another patient at the time.

This was one of several coverups after Kings County claimed it cleaned things up, internal records obtained by the Daily News under the Freedom of Information law show.

All occurred after an incident that drew much public outrage: the June 2008 death of Esmin Green. Staffers claimed in records Green was fine while video showed her lying on the floor - ignored and dying.

Kings County's Behavioral Health Program has been the subject of an ongoing suit filed by the Mental Hygiene Legal Services and the U.S. Justice Department. The suit was settled in January, but a judge will monitor reforms implemented by the city agency that runs the hospital, the Health & Hospitals Corp., for five years.

HHC spokeswoman Ana Marengo said Kings County has opened a new psych ward, and the agency had implemented "numerous improvements."

"Kings County has put in place a robust internal system of monitoring and accountability to prevent inconsistency in reporting or alteration of chart documentation. Employees who do not comply with the policies face severe disciplinary actions, up to and including termination," she said.

HHC noted the hospital's Behavioral Health program was fully accredited in 2009 and that the state Office of Mental Health found improvements in an inspection last week.

Still, state investigators found repeated instances of inaccurate record keeping, staff shortages and other problems continuing months after the Jan. 9, 2009, shakeup announcement.

Much of this emerges in a November 2009 Health Department "statement of deficiencies."

The 62-page statement obtained by The News resulted in Kings County being cited for 16 violations, including failing to file reports, provide a "safe environment for patients" and keep patients "free from abuse and harassment."

Kings County was also cited because a psychiatrist they hired to help them respond to Department of Justice recommendations "was unable to provide any information" regarding the hospital's compliance with DOJ to state investigators. Instead, he referred them to a hospital staffer.

The consultant, Dr. Jorge Petit, has been paid $1 million since HHC hired him in January 2008. He declined comment. HHC said Petit's comments to DOH were "misunderstood" and later "clarified."
