Re: Californian Biker Dies After He Rear-ends a Dodge Avenger Making a U-turn
Realistically, the driver is not in much trouble. He showed simple negligence and immediately rendered aid, so at worst he'll face a misdemeanor vehicular manslaughter charge. Felony gross vehicular manslaughter in CA requires gross negligence, and careless inattentiveness doesn't meet that threshold. He might get 6 months of probation, a $750 fine, and 40 hours of community, or something like that. Or he might face no charges at all, beyond a ticket for failure to yield.

in all fairness to the driver of the car , yes he turned in front of him but the bike was speeding way too fast, 6 of one and half a dozen of the other if you ask me ! |

I don't think they deserve death, but I happen to agree with the sentiment. You drive a vehicle that offers no protection outside of wearing a helmet around other vehicles weighing multiple times as your motorcycle...

Re: Californian Biker Dies After He Rear-ends a Dodge Avenger Making a U-turn
The bane of motorcyclists everywhere!!! Car driver - “I never even saw him!”... The driver of the car didn’t see the motorcycle until well into the turn... The car actually speeds up a bit to try and avoid the accident, hoping the bike would also swerve enough for both to avoid any contact, but it was just too late, unfortunately. I believe the car had enough room to complete his turn... though he was still cutting it close, and speeding too! I agree that the car driver probably should have waited for a better opportunity to turn. He probably would have if he had seen the motorcycle too. The cyclist was speeding, of that there’s no doubt. If he had been able to slow down enough, or just not speeding to start with, he could have avoided this accident! This accident was definitely preventable... |

Re: Californian Biker Dies After He Rear-ends a Dodge Avenger Making a U-turn
Did the biker rev his engine right before he hit? Sounded like it, but correct me if I'm wrong. If you've watched youtube videos of bikers, you'll notice a lot of them tend to rev their engines in annoyance instead of sounding the horn or moving out of the way. If this guy had time to rev his engine, he should've had time to swerve... |
