Ever heard of a warning shot? Would the desired effect be a quick retreat by the attempted intruders? Just asking. I know for sure that I never want to make that decision.

I basically agree with everything in your post if it could be proven that the perp actually saw the shooter.

For me, the issue is whether he turned to flee because he saw something through a cracked door and or did he feel the knob being turned and realize that someone was home.

These guys lacked any sense of urgency and weren't being especially attentive to what they were doing. Then suddenly, the peep bolts before his partner realizes what is happening.

This happened so fast. If the perp saw the shooter through the cracked door, I don't think he gets time to turn around. Additionally, his partner probably reacts at the same time because he's facing the threat.

I'm not sure whether the door has a window, but if the perp saw someone through the glass, he would have gotten further away.

We will never know for sure from this copy of the video. For me, this is an intriguing case and it would be interesting to have more background information.

That gave the homeowner and the perps a good look at each other right before the shot was fired, if my assumption is correct. The door seemed to be locked (looked like one of them was tugging on the handle) which was smart of the homeowner. This situation is scary enough without having to engage someone already inside your home. Good lesson to keep doors locked at all times.
Home invasion have to be one of the stupidest crimes a person could commit, or in this case try to commit. Everyone has Ring doorbells, cameras and most people have guns.

I initially thought it was a slider, but their nonchalance had me thinking it must be a hinged door with a knob that they still hadn't checked. Many rear patios and porches have French doors. If it were a slider, I assumed they would have been standing at the far side of the doorway instead standing there socializing in plain view. Then again, they don't strike me as very accomplished criminals.

I downloaded the video so I could watch it on an app that allowed me to zoom in and slow down. It's difficult to tell at this resolution, but it does appear that just as they started looking through the glass, both of them saw something. The timing, distance, and angles would be consistent with them seeing the homeowner approaching the door, sliding it open, and firing.

After typing all of that, I realized that the knob would be on the other side on a French door, so it's definitely a slider.

For me, this continues to fall into a grey area. Even if the prosecutor were to determine that no criminal charges are warranted, I would think that the homeowner still exposed themselves to significant civil liability by firing as soon as they did.

Even if it's not required under the law, I would think that announcing that you are armed and will shoot if they don't leave immediately leave would reduce one's civil exposure (especially if you get it on camera).

It's something to keep in mind if you believe you would do exactly the same thing under this exact set of circumstances.

Anyway, I've spent far more time on this thread than I wanted. 3 f*ck off's in 3 days wasn't a bad price to pay.

He was running away.
This is murder.
BAD SHOOT.
Homeowner is going to prison its no different than if you are both fighting outside and your attacker is running away and you shoot them in the back.

How you CERTAINLY know that “a round in the air” will suffice? That’s almost as stupid thinking as “warning shoot to the leg”. You dont know how many guns the bring, or how many others companions they have. But we DO know the homeowner has only ONE gun (at least that we know) and that the moment he/she decided to shoot, was before the guy tried to run. The one in blue WAS running, so in fact, going after him and shooting him WOULD BE a manslaughter. But was not the case here.

I think it's pretty conclusive that they've started to turn away before the door has been opened enough to take the shot. It's unclear if the perps ever opened the door. If they did, the homeowner still had to open it more to be able to take the shot.

A weapon should only be fired in this situation with the intent to kill. Warning shots aren't really an option.

I no longer own a firearm, but am not adverse to having one. I don't think I'd hesitate to use one in self-defense.

Again, I don't know what the law requires, but it seems to me that going up to a glass door in order to take the shot is not the best tactical play.

If the perps were armed, you've become a target with a numerical disadvantage. If they aren't, you're probably exposing yourself to significant civil liability and possibly criminal charges.

For me, I'd rather provide them with the opportunity to escape than pay some lawyer thousands so I can keep my freedom and my house.

It think the better play would have been to take a more tactical position where it was still possible to take the shot, but with some distance and cover. Next, I would tell them I'm armed and will fire if they don't immediately leave. What they do next would determine their fate.

I don't think I'd hesitate to fire the instant they breached the door.

I'm not sure whether I could be criminally charged or sued, but I would genuinely be in fear for my life so it wouldn't matter.

Amazing that even on a gore site you get morons that try and somehow defend the criminals. Anyway, great job by the homeowner.
