Re: 68 Year Old Biker Fatally Hit by Lexus Driver
Forgive me if I am off the mark here, but hitting someone who was in your lane from behind usually is the fault of the person doing the hitting. I understand if he had crossed traffic it would be the fault of the deceased. Where I come from you need to be aware if someone ahead of you slows down. Or am I a fucking idiot? |

I think that was her fault. He was stopped in the road but that can happen for any reason which is why you need to watch your speed and look ahead for hazards. It was a long straight road. She ends up in the opposite lane stopped like him making her just as much of a hazard as he was. If someone then plowed into her from that distance ahead they’d be at fault too. |

Re: 68 Year Old Biker Fatally Hit by Lexus Driver
To me, it's quite clear she was about to attempt to make a pass of the biker in the oncoming lane. She was moving at good speed and was approaching a slow moving motorcycle/moped. As soon as oncoming traffic passed, you can see her move to cross into the left lane, before the biker had motioned to do the same for his u-turn. Appears to be a double solid line, so while the move was illegal for both parties, it was her move that ended up killing someone, and she should be deemed mostly at fault.

Re: 68 Year Old Biker Fatally Hit by Lexus Driver
He probably was using the chin strap. There's an unbelievable amount of people who just don't strap it correctly. Or are wearing the wrong size helmet. Either can cause your helmet to fly off in a collision. It's amazing how many people you'll see who don't slipknot the strap if you pay attention. And if they do strap it correctly, you should always do a quick pull to cinch the slipknot tight. And then decide if it's possible for your helmet to come off. I think most people have a helmet that's too big as well. Because a helmet that fits correctly should be uncomfortable. At least until you get used to it and it breaks in a little. You should have impressions and lines and red marks on your face when you take it off. |
