That looks nothing like the stab proof pens I have seen. That looks like a Bic ballpoint biro, not standard gear at all in most prisons - people can use them to manufacture syringes, weapons and the rest. My guess is that has been stolen and smuggled in. A bendy pen would never cause that type of injury either.
