Re: Nick West
I think the fact you make such a statement suggests you do not understand the issue and should probably do a little research about bias and the behaviours is creates.

Re: Nick West
Using that logic, there would be no distinction between manslaughter and murder because, well, the end result is the same...someone is dead. But the law distinguishes a premeditated murder from a heat-of-passion killing. Criminal law concerns itself with the state of mind of the offender because society views deliberate, malicious acts as more morally blameworthy. Hate crime legislation says that crime motivated solely by hatred against a certain group deserves more serious punishment. This is arguable, but I don't think its a bizarre concept. |

Re: Nick West
The primary intent of hate-crime legislation and thus hate crime laws was to assure that crimes committed against marginalized peoples - for their being marginalized peoples - would be reported and subsequently investigated. As one can well-imagine, there are certain victims of crime that certain police officers and certain police agencies are not especially interested in investigating (chief amongst such people being LBGTQ people and black people). Hate-crime laws, then, legally compel law enforcement agencies to report such crimes to the Department of Justice (DOJ), thereby enabling the DOJ to monitor the progress of the investigation of these crimes. Simply stated, prior to the enactment of hate crime laws, crimes committed against the likes of gay people - for their being gay, etc. - were often ignored by police precisely because these crimes were committed against gay people and the like. Hence, the need for hate crime legislation. |
