to answer he was sentenced to both... however only received a month jail sentence, like 5 years of probation and never allowed to drive in florida again.. fair? you tell me

That's exactly it. Look at the minimal damage on the front of the car and the inward damage to the windshield. This was definitely a pedestrian hit and head/face went through the windshield.
