The implied consent act (that every licensed driver signs) states there is no warrant needed for a blood draw for a DUI/DWI investigation. If the blood draw was for any other crime a warrant is required. If this was a DWI/DUI investigation and she failed to comply then she should be arrested if it wasn’t then he over stepped. It’s pretty simple.

The arresting officer was fired on October 10, and his supervisor was demoted two ranks from Lieutenant to Officer. |

Why don't you read a little background on this story before posting generic drivel. The nurse was in the right, the officer was overstepping his bounds. Since you're too lazy to read the Wikipedia article presented in the thread I'll summarize it for you. The driver was not arrested or charged or under suspicion of dui nor was there a warrant for blood draw. |
