The court of protection conducts a very thorough assessment of the situation, and all aspects relevant to the case. They look at everything really, from the woman's ability to say no (many autistic people have problems saying no), her ability to understand the act itself, the possible consequences of the act and the impact on her if she becomes pregnant or catches a disease etc. The court will talk to everyone involved, including her previous partners if possible. They will weigh up the person's ability to be a parent, and this could be where the matter rested uneasily. There is long held belief that autistic people have little or no empathy with others. Many do not seek out others for company, and may be seen as unfriendly, unsociable and awkward. Anyone who knows people with autism will disagree with that, as do I. However the court can't spend enough time getting to know the person and so don't get to know how they express love, care and humour. But I bet they did try. The court will always apply the "Best Interests" test to reach their decision, it's patriarchal, but there doesn't seem to be a better way to it. |
