It wasn't the truck drivers fault even though the turn was illegal, it was the vans fault for going too fast and not leaving enough room to stop. Look how fast he hits the truck. What the F is that? The guy was driving like an asshole. It doesn't matter if the truck was making a turn or was coming to a stop at a light

He can be but it’s really the discretion of law enforcement. It appears they are charging him with vehicular homicide though the charges likely won’t stick unless there are compounding factors not apparent in the video. A lot of the traffic law terminology can be confusing as things called illegal are often just indicating liability and not an actual criminal action. That’s why most accidents end up with civil and not criminal lawsuits. It’s also why in regards to traffic laws you usually get a citation and not a charge. Think of it this way: You get a speeding ticket or failure to yield right of way citation…you broke the traffic laws. Later you apply for a job and they do a background check (assuming not a driving job). These are not showing up as a crime you committed. |

To add on to this like I mentioned previously it depends on the state. The state I live in does not have vehicular homicide or vehicular manslaughter charges. This alters the way they approach things a bit as if you meet their threshold they are charging you with straight up Homicide or Manslaughter. A lot of people don’t understand the extreme variation states can have in these matters.

I take back what I said about the charges not sticking. It appears the CDL was illegal which should qualify this as an accident caused during the commission of a crime.
