Again great post Kelly!! Here is some more info I found. Unfortunately he still waits to be executed. Oregon has not executed but 2 people on death row since the mid 70's. I guess they like keeping them around. Anyway here is what I found. . Dayton Leroy Rogers filed appeals with the help of his lawyers, and on two occasions the Oregon Supreme Court overturned his death sentences. His first sentence was overturned in 1992 and was based on a U.S. Supreme Court ruling of a case in which the court decided that juries must consider additional factors, such as evidence of a troubled childhood and whether or not a defendant may have suffered brain damage, in death penalty cases. After costing the state much additional money, a jury resentenced him to death. However, in 2000, the state Supreme Court overturned his death sentence a second time, this time by deciding that the lower court that had sentenced him was in error by giving a jury only two sentencing options — death, or life with the possibility of parole. The convictions for his crimes were never questioned, but the higher court wanted to ensure that a jury had a third option to consider — life with no possibility of parole — before imposing a death sentence. It turned out that Rogers was sentenced to death again, this time on March 7, 2006. Since the reestablishment of the death penalty in 1976, Oregon has executed only two inmates. Rogers, now 55, sits on Oregon's Death Row awaiting an appointment with the executioner's needle for his crimes against society. |
