The scenario of the mis-identified passenger reminds me of a forensics/police drama I saw the end of about a month ago. I was on a stationary bike at the gym just flipping through channels on the LCD and caught the last ten minutes. I can't remember what show it was. The twist at the end of the show was that the mother of the girl that was presumed dead suffocates the survivor in her hospital bed with a pillow. Later, the cops are talking to her in jail. The cops are telling her what actually happened as you see a flashback of the night of the accident. It turns out that one of the girls is drunk, so she has her friend (who looks alot like her) drive. The drunk girl gives the sober girl her driver's license in case they get pulled over, so initially the cops identify the passenger as the woman's daughter, so the woman kills the "other" girl in the hospital, thinking it was her daughter's friend (because of the license). The cops tell the mother that the girl she killed in the hospital was actually her daughter.

Another thing that's fucked up is that the girl that lived is going to take years to get her identity back, since she was registered dead at social security, which means her number was freed up to be given to a baby (though it probably wasn't, not enough time passed, but it'll still have to be re-registered in her name), and any time she applies for anything big like an ID or a loan, she'll run into problems with being denied and investigated because they do an auto check with SS that will show up as 'deceased' for years (it takes forever for them to fix these things when they occur). As a bonus however, she'll be able to say that she knows who would show up at her funeral!
