Feb. 26. 2020. CLEVELAND, Ohio -- A judge on Wednesday ordered a Cuyahoga County Jail supervisor to serve nine months in prison for delivering a brutal attack that prosecutors called “nothing short of torture.”

Cpl. Nicholas Evans, who was caught on jailhouse security video turning off his body camera and pummeling a mentally ill inmate strapped into a restraint chair, will himself become an inmate.

Common Pleas Court Judge John P. O’Donnell sentenced Evans to serve his sentence at Lorain Correctional Institution.

O’Donnell also sentenced Timothy Dugan, a corrections officer who also delivered blows to Terrence Debose’s face on March 22, 2019. Dugan will spend 10 days in the Geauga County Jail.

Debose, who became emotional during an interview after the hearing, said the sentence amounted to “a slap on the wrist.”

“If you look at that video and you say that was justice, you’re not a human," Debose said.

Evans pleaded guilty on Oct. 15 to attempted felonious assault and tampering with evidence, third-degree felonies. Dugan pleaded guilty to attempted abduction, a fourth-degree felony, and misdemeanor assault.

Evans faced a maximum sentence of three years in prison. Dugan could have received up to 18 months behind bars. Both have been on leave since they were charged in April. Their lawyers said the officers would submit letters of resignation immediately after Wednesday’s hearing.

Dugan has cooperated with investigators since his arrest and prosecutors plan to call him to testify on their behalf at future trials involving jail guards and management.

Evans has not cooperated with investigators.

Both men apologized to Debose, who sat in the courtroom next to his civil attorney Paul Cristallo.

Special Assistant Ohio Attorney General Matthew Meyer called the attack on Debose especially troubling because it came four months after a 58-page report by the U.S. Marshal Service documented rampant constitutional violations in the jail.

“Everyone in that jail knew they were under a lens and their behavior was under close scrutiny, and yet this third world behavior is happening,” Meyer said in court. “It’s no stretch to call this torture, and anyone who would say I’m exaggerating that or stretching that should strap themselves into a restraint chair and volunteer to get pummeled with a spit mask on, just like Mr. Debose, and then tell me it’s not torture.”

Meyer played the surveillance video that showed the beating of Debose, who was in the middle of a mental health episode after his arrest on burglary, assault and drug-possession charges.

Prosecutors also played body-camera video of another supervisor in the jail taking Debose to the jail’s medical unit to see a nurse several hours after the beating.

The video showed Debose, still strapped to the chair, explaining to the sergeant that he was mentally ill and that he was seeing stars. He urged the supervisor to pull the security video.

“Why would they beat me,” he said. “I was born this way. It’s not my fault.”

Debose asked a jail nurse to “see what is wrong with my head." He then began to weep.

“Oh my god, I might get brain damage,” he wailed.

Debose sobbed in the courtroom as his plea for help played, and he left the courtroom in the middle of the presentation. Evans and Dugan showed no emotion as they sat at the defense table.

The jail’s medical staff did not order Debose to see a doctor, Meyer said. They gave him two Tylenol and sent him back to a cell.

It wasn’t until investigator Robert DeSimone spoke to jail medical director Dr. Thomas Tallman as part of an investigation into the attack a week later that Tallman learned of the incident, Meyer said. Tallman examined Debose that day and found that he had post-concussion symptoms and ordered him transferred to MetroHealth. A doctor found Debose’s head and neck injuries were similar to whiplash during a car crash, Meyer said.

Meyer also played a clip of an audio recording of an interview in which DeSimone and Meyer asked Debose what he wanted to see should his abusers be prosecuted.

“I do forgive them, because I know how it feels to be forgiven for things I’ve did,” Debose said. “I just think maybe they should get a year [in jail] or something. Because I didn’t deserve that.”

Cristallo said in a statement that, were it not for the wall-mounted security cameras, no one would have believed Debose’s claim that officers beat him.

“For too long, the Cuyahoga County Jail has been an environment where people were willing to look the other way in the face of abuse, neglect and mistreatment,” Cristallo said.

Both Cristallo and Evans’ attorney, Robert Dixon, attacked the management of a jail that has had well-documented understaffing of corrections officers and severe crowding of inmates.

Dixon said that Evans, who was assigned to the jail’s mental health pod, had no additional training for handling inmates who suffer with mental illnesses. He likened conditions in the jail to “a pressure cooker.”

Evans’ initial defended the attack by saying that he blacked out after Debose made several derogatory comments about him, his wife and his family. Dixon said immediately after the incident, Evans told Dugan that they had to file a report of what happened.

“He knew that when he wrote that report, he was ending his career as a CO,” Dixon said. “But he’s the kind of guy that he knew maybe he should end his career. He snapped, he let his emotions get the best of him.”

Dixon said the video of the attack on Debose was brutal, shocking and hard to watch, but it depicted “a very good man on his very worst day.”

Dugan’s attorney, Ohio Patrolman’s Benevolent Association attorney Adam Chaloupka, also said that the attack on Debose was the worst decision his client had made. Chaloupka stopped short of citing any staffing or training issues.

“You don’t need training to know that you can’t hit a fully restrained inmate,” Chaloupka said.

Let's not worry about the countless number of inmates who are simply being stitched up, lose everything so the local police force can tick another box.
