4 Cops Relieved of Duty After Tipping Over Portable Toilet with Suspect in It

Memphis police chased and cornered a suspect inside a portable toilet at a construction site.

The officers then tipped the toilet over, leaving it that way while they cleared the other toilets. Around a minute later, the suspect exits the john and is kicked in the rear-end.

Investigators identify the suspect as Joseph Hampton, who was wanted for criminal trespassing and evading arrest.

MPD launched an administrative investigation into the situation, and the 4 police officers were relieved of duty.

Ok, that was rather old school...love it...can't do that anymore...but I love it.

I'm gonna get a ration of shit from the DR Anti-Police Brigade anyway...so I'm going to just say what I would if I were hired by the Memphis Police Association to defend the officers actions.

First off...that really was a great improvised tactical move in turning over the porta-potty. Notice the officers turned it over with the door facing down so the bad guy couldn't get away or attack the officers while they cleared the other three potties. It's actually pretty clever and I commend the officers for their novel technique. Now, from a safety factor, I'm not sure that it was a really great idea to handle a suspect potentially covered with raw sewage...and then play rock paper scissors to figure out who would transport the poop covered idiot to the police station. I really saw nothing blatantly wrong from a legal or policy issue with turning over the porta-potty...it can easily be argued that it was a tactical ploy. Just make note...don't hide from the police inside a porta-potty.

Now, the real legal issue will be the unwarranted and intentional kick administered by one of the officers to the rear end of the bad guy. Now, I personally feel that when a bad guy runs away and makes me chase him...then he should expect to get his ass and other body parts kicked, hit, and poked...in a highly professional manner of course, but kicked, hit, and poked, none the less.

Of course, in today's more liberal less hands on law enforcement climate, unwarranted physical assault under the color of authority is highly frowned upon. That particular officer is probably going to be toast. Of course he might argue that with the physical/mental stress of the foot pursuit...he just lost control and kicked the asshole in the butt. The other option is to argue that the kick was administered as part of a tactical plan to knock the suspect tonthe ground because the officer thought he was going to flee. In all probability, the officer is going to have to take his lumps and hope he isn't terminated. I would doubt he'll be prosceuted, but I'd say his job is in real jeopardy. If these officers had just turned over the porta-potty, cleared the other porta-potties, and handcuffed the bad guy...I think they would have been fine. But the one kick is going to cost them and might put the whole incident in question. Once this gets political then all bets are off.

There are actually folks that do just that...it's usually the same guys that do crime scene clean up. The city or county will have contracts with those folks to clean up hazardous spills in the patrol cars (blood, vomit, pee, poo, and other ghastly stuff) and jail.

You mean like handcuff lock the door and tie a rope around the porta-potty and just drag it behind a patrol car with lights and siren to the station? Can you imagine? That would have been epic. If you're going to get fired...get fired in a big way.
