FULLERTON (CBS) — The mother of a mentally ill homeless man who died after he was beaten by Fullerton police has reached a settlement with the city that will pay her $1 million.

The settlement agreement unanimously approved Tuesday by the Fullerton City Council resolves Cathy Thomas’ legal claims against the city regarding the death of her son, Kelly Thomas, 37.

His father says any money he receives will be going to the Kelly Thomas Memorial Fund.

His son died in July 2011, five days after his confrontation with Fullerton Police Department officers.



A Superior Court judge last week found there was enough evidence for Officer Manuel Ramos to stand trial for second-degree murder and involuntary manslaughter and Cpl. Jay Cicinelli to face a trial for involuntary manslaughter and excessive force.

The settlement follows that preliminary hearing, during which a 33-minute video and audio recording of the incident was played.

The recordings horrified some people in the gallery immensely who chose to leave the courtroom.

“The blood of Kelly Thomas is on this city,” a member of so-called “Kelly’s Army” said.

The beating sparked outrage in the community and resulted in an effort to recall three council members in next month’s election.

This all could have been avoided if he had just stopped resisting. I love how he keeps saying 'I'm sorry' as he continues to resist and fight. In my opinion he was on something to keep resisting for so long with 5-6 cops on top of him. That is not him getting up and running, and trying to fight with them. If it took that many cops to hold down a 150 pound soaking wet kid, I'd hate to see what would happen if they got ahold a real man.

That poor kid was mentally ill, if if I am not badly mistaken, don't "police officers" have training to deal with such suspects ? Oh yeah, they used that training didn't they ? They KILLED him. Some training huh ?

I'm not clostraphobic but I do panic if someone is standing over me when I'm on the ground and I would go crazy if cops tried to cuff my hands behind my back. I would comply with the cops to go in a van or car but if thet tried this on me I would try to kill them.

I live near by to the cite of the incident. Fullerton is full of financial problems. Paying 1 Million for this type of shit gets me so very mad.
The cop should have been more professional. Unprofessional and unqualified peace officers are draining Orange/L.A. County. Los angeles county peace officers are responsible for some of the most expensive court settlements in the country. This is what you get when the people in charge of peace have hardly any post high school education.

If you don't follow a cop's directions to a tee, and even more so, if you have the audacity to walk away when he's standing there threatening to beat your ass instead of doing what he's supposed to (cuffing you to question you about a crime you might not have even committed), you definitely deserve to be beaten to death. Hell, if you so much as offer any protest to a demand by a cop, you should at least be put in the hospital. I'm all about Songun as well. We should institute policies just like North Korea. The lives of citizens should be much less important than absolute obedience to police and military. It's all about the good of the whole. how do you get that we should have policies like north korea?...the guy didn't so what the cop said..of course..but, you can clearly tell that the cops were beating him...and continued to beat him...which was totally unnecessary. cops are just people, like everyone else...if your opinion were the law...you seem to think that cops should me considered more human than anyone else...everyone has rights...including cocksuckers who break the law...you must be a cop...or, your parents are/were. There's no need for a cop to act this way, the taser was enough, nobody is going to stand there and take a beating without trying to escape....it's in our nature. i suppose they should be allowed to just shoot you for running away too?...wow, go live in south korea or some other communist nation if that's your way of thinking. cops should act like they do around here...cops here have common sense and don't try to act like they're better than anyone else..We occassionally get one that's a douche..but, they're normally fired after their first beating...
