You also must keep enough distance to the vehicle in front of you that you can reliably stop even if this vehicle is suddenly breaked.

Thus the car driver is completely culpable. In terms of damages he might share cost with the bike driver or his estate, but in criminal terms he is guilty, guilty, guilty.

I think he knows he is guilty because i think he deliberately did that.
