SOLON, Ohio — The Cuyahoga County Prosecutor’s Office has cleared Patrolmen Steven Davis and Nicholas Kline in the fatal shooting March 17 of Kevin Bailey on Bainbridge Road after a traffic stop.

The Ohio Attorney General’s Bureau of Criminal Investigation conducted the investigation and turned their findings over to prosecutor’s office, which presented the case to the Grand Jury. (Read the report in the document viewer below).

The prosecutor’s office and the grand jury agreed that "there were no improprieties in the officer’s actions and that the use of force was justified based on the actions of the suspect," Solon Lt. Bruce Felton said in a news release issued today.

Davis and Kline have returned to regular duty.

Chief Christopher Viland said he is grateful that no Solon officers or civilians were seriously injured or killed by Bailey during his attack.

"I don't think there was ever any question that the actions taken by the Solon police on that night were unfortunate but necessary and completely driven by Mr. Bailey’s unprovoked choice to shoot."

Police stopped Bailey, of Sylvania Township in Lucas County, at 9:45 p.m. on Bainbridge Road at Sharondale Drive, but he pulled away, drove a quarter mile to Sunnywood Drive and turned, driving over a curb.

Officers drove up to the disabled car and, before they could get out of their cars, shots were fired at both police cars.

Davis was shot in the bulletproof vest and left arm.
