Location The United Press Service of the Courts of St. Petersburg on May 12, the court granted the investigator's motion, ordering 63-year-old Valery Shevelev to restrain from certain activities. Among other things, the defendant, accused of violating traffic rules that resulted in death by negligence and is prohibited from driving until the restraining order is lifted or amended. Shevelev asked not to be deprived of the right to drive. He works as a driver. According to the investigation, at 8:00 a.m. on May 10, the defendant demonstrated criminal inattention to traffic conditions when he reversed a garbage truck belonging to ECO LAND. According to the documents, he failed to ensure the maneuver was safe, failed to seek assistance and was traveling more than the speed of 5 km/h, striking the pensioner. Shevelev fully admitted guilt during the hearing. He pleaded with the judge not to place him under complete house arrest or jail detention, arguing that he needed the ability to support his family. Under Article 1068 of the Civil Code of the russian federation, an employer is strictly liable for any harm caused by its employee while performing their official work duties. The victim's family has the right to sue Eco Land directly as the primary civil defendant, rather than seeking massive funds from the 63-year-old driver individually. In russian legal practice, the victim's next of kin typically file a civil lawsuit directly integrated into the active criminal trial. This allows the judge to rule on both the driver's prison sentence and the corporate financial compensation package simultaneously at the end of the trial. |
