The guy who was killed had 38+ incidents of violence, bad temper and attacks on other with deadly weapons. So these two will probably get light sentences at worse. Mostly for looking and acting dumb. If I had a big fuck telling me he was going to kill me id would do it first as well.

They were indicted by a grand jury, charged with murder, and had to post $100,000 bond each. They instigated the encounter, one of the shooters flashed a gun prior to the victim arming himself, and the other shooter actually left and later returned with a gun. They also both fired after the victim had disarmed himself by throwing the bat and missing. The entire encounter happened on public property.

The victim's criminal record will in all likelihood not be brought up in court. Bringing it up would also be a risky strategy even if it is allowed, because it could make the defense look like scum in the jury's eyes for trying to "put the victim on trial." In either event, instructions from the judge could render it a moot point since the only question is whether or not the shooters had reason to believe that their lives were in imminent danger based on the circumstances at the time. The victim's record can't be argued as having had any bearing on that belief had the shooters not been aware of it at the time (which they in all likelihood were not).

So TL;DR, my money says they're fucked when they go to trial, especially since there's video evidence of the entire incident.

Oh, and they also ordered at gunpoint the victim's significant other to lay on the ground after the victim was shot even though she was clearly no threat to them. That in and of itself could mean serious charges in addition to the murder. I haven't seen any news of their being charged for that action, but the prosecutor could still charge them for it later on down the line.
