This was on the news tonight. talk about the guy who's foot did the damage being arrested and charged with manslaughter. that would mean they are saying he meant to do it.

Wrong.

Manslaughter is without malice aforethought. Manslaughter doesn't come with intent.

Intentional murder would be 1st degree. 1st degree is willful and premeditated with malice aforethought

Murder in the 2nd degree, they may have intended to kill another, but did not have time to plan it.

Murder in the 3rd degree is death that results from recklessness or inattention.

Difference between Manslaughter and Murder, both are Homicide


Homicide literally translate to human-homi, killing-cide and is typically a general statement. Homicide is actually a neutral term, it only denotes a person was killed, not intentional or otherwise. MURDER and MANSLAUGHTER are the degrees of homicide. One with and one without malice aforethought

I took a quick look at it frame-by-frame, it looks like he was trying to regain his balance after the other dude hit and pushed him. In my completely totally 100% absolutely professional opinion, I say it was a freak accident. Wrong place, wrong time. Had whats-his-face been a foot to his right, the blade would've completely missed.

UK is different, although he was American...... It happened in the UK.
