The guy was behaving suspiciously thats why he was recorded. Also I need to mention that the incident happened on metro line 3 which isnt exactly known for being safe. One would have to be a dumbass to whip out an expensive smartphone while traveling on it. By the way, thanks to this recording the guy was caught in 24 hours, but he already sold the phone for about 100$. In his testimony he stated that he needed the money for his sick mother to get meds (yeah right), but the court based on his previous 15 (!) convictions and the fact that he was released on parole from prison 2 months prior to this incident, sentenced him to 1 year and 4 months without parole and added an extra 4 months for the parole violation, so all in all he will have to spend 20 months in prison.
