New York (CNN) -- A motorcyclist accused of gang assault and other charges in connection with the videotaped attack on an SUV driver was ordered held Tuesday on $150,000 bond.
Craig Wright, 29, is accused of stomping driver Alexian Lien at least twice after police say he and other motorcyclists forced the man's SUV to a stop, used their helmets to break out the Range Rover's window and dragged him out of the car.
According to court documents, police say Wright identified himself in a picture showing him standing near the stopped SUV. Another photograph shows him stomping Lien as the man lies on the ground, according to the documents.
Wright is charged with first-degree gang assault, first-degree assault and first-degree unlawful imprisonment. He was arrested at his home in Brooklyn, New York.

In March, Wright pleaded guilty to driving with a suspended license, a spokesman for the Brooklyn district attorney's office said. It is unclear whether he was driving with a suspended license at the time of the SUV incident.
He was also convicted in Virginia in 2005 for reckless driving.

He is the latest person to be charged in the case, which involves a group of motorcyclists on Manhattan's West Side Highway and Lien, who was driving the Range Rover along with his wife and small child.

Reginald Chance, who was captured on video smashing his helmet into an SUV window, has been charged with first-degree assault and gang assault. He was ordered held on $75,000 bond Sunday.
Assistant District Attorney Samantha Turino said Chance's license had been suspended and he should not have been driving. She said his arrest record includes a marijuana charge in 2013 and attempted criminal possession of a weapon in 2006.

Lawyers defend two motorcyclists
"The law does permit someone who is a victim of an accident to at least attempt to get the identification of the motorist," attorney Gregory Watts said. "My client obviously overreacted in that manner,
but he is not this thug assaulting someone who's harmless, contrary to the public opinion that's being put out there."

He said Chance was knocked off his motorcycle by Lien's SUV after bikers had surrounded the vehicle earlier.

Christopher Cruz, 28, who police say is the biker who slowed in front of Lien, was charged with reckless driving and other misdemeanors. He was released on bond.

His lawyer, H. Benjamin Perez, said, "He never tried to assault him in any way. And he does not know any of the other motorcyclists who were involved in this beating."

Another biker, Robert Sims, is accused of stomping on Lien. He surrendered Friday on charges of attempted assault and gang assault.
New York police: Bikers stomped on SUV driver
The case became national news after video of the incident surfaced.

The video, captured by a motorcyclist's helmet camera, shows dozens of bikers swarming past him on Manhattan's West Side Highway. One motorcycle quickly slowed down in front of Lien, who bumped its rear tire, slightly injuring rider Christopher Cruz.

Lien pulled to a stop, and angry bikers surrounded his vehicle, hitting it and spiking its tires, police said.

Lien's vehicle plowed into three more bikers, including Edwin Mieses, whose wife says he is paralyzed.

The video shows the Range Rover stopping again -- long enough for a biker to open the door -- and Lien then driving away until traffic forced him to the final stop.

Police say the subsequent beating included kicks to Lien's head and body as he lay on the highway. Lien suffered two black eyes and cuts on his face and side, requiring stitches, a police detective's criminal complaint said.

His wife and daughter were unharmed.

Defenders of the bikers, including the relatives of one biker who was critically injured, have criticized Lien for driving through the crowd of motorcycles.

Investigation involves off-duty cops
Off-duty police officer among bikers who saw SUV driver beaten

At least two off-duty undercover police officers who were riding with the motorcyclists that day are being questioned by internal affairs, a law enforcement official told CNN.

One of the officers reportedly told internal affairs investigators that he didn't come forward for four days because he was reportedly afraid his cover would be blown. The officer has been assigned to desk duty. He has hired a lawyer, sources told CNN.

The officer was riding with his motorcycle club when the incident occurred and saw much of the confrontation, a law enforcement source told CNN on Friday.

CNN's Steve Almasy wrote from Atlanta; CNN's Susan Candiotti, Chris Welch and Margaret Conley reported from New York; CNN's David Simpson, Tom Watkins and Greg Botelho reported from Atlanta.

CHARGES UPGRADED AGAINST UNDERCOVER COP INVOLVED IN BIKERS v. MOTORIST ASSAULT

Updated at 07:04 PM OCT 9, 2013 ABC LOCAL NEWS
Eyewitness News

NEW YORK (WABC) -- An off-duty undercover New York City police detective appeared in court on Wednesday to face upgraded charges of 1st degree assault and gang assault in connection with the brutal attack on SUV driver Alexian Lien on the Henry Hudson Parkway.

Undercover narcotics officer Wojciech Braszczok was arrested Tuesday night after investigators found video showing Braszczok punching the rear window of the SUV.

In court on Wednesday afternoon, prosecutors argued that he was an active participant in "terrorizing the family," breaking the rear window of Range Rover and kicking the rear passenger door where toddler was sitting. He didn't call 9-1-1 and failed to tell superiors for two days, prosecutors said.

Officials say the officer initially told investigators that he came upon the scene as the beating was ending, but sources say his story began to unravel when the NYPD acquired the new video, which has yet to be released to the public.

Braszczok's attorney says he's been overcharged, and argued Braszczok was 12 feet from the victim and never attacked.

"This particular video in question exonerates my client - it is an absolute overcharge," he said. The SUV's back window already had a "gaping, softball-sized hole" in it, he said.

Braszczok was released after posting $150,000 bond set by the judge. (article continues; excerpt only here)

Undercover Detective Is Arrested in Attack on S.U.V.
By J. DAVID GOODMAN
Published: October 8, 2013

An undercover New York City police detective who was among a group of motorcyclists chasing a sport utility vehicle on the West Side of Manhattan last month was arrested on Tuesday evening for his role in the episode, in which the vehicle was damaged and the driver was beaten, the police said.

The detective, Wojciech Braszczok, 32, was off duty at the time, and had told his lawyer that, while he had followed the motorcyclists from the Henry Hudson Parkway onto a Washington Heights street, he left once some of the riders began attacking the vehicle.

But investigators found his story suspicious from the beginning — in part because the detective took several days to come forward after the violent and chaotic episode on Sept. 29, said a law enforcement official, who spoke only on the condition of anonymity because the detective had not yet been arraigned.

Detective Braszczok’s story was contradicted, the official said, by video taken at the scene, as well as by witness statements. In the video, the detective can be seen pounding his fists on the back of the vehicle.

It was not immediately clear whether Detective Braszczok struck the driver, Alexian Lien, 33, after he was pulled from the black Range Rover by other motorcyclists in traffic on 178th Street, the official said. The detective was charged with riot and criminal mischief, though more counts could be added.

A phone message left at the office of the detective’s lawyer Tuesday night was not immediately returned.

Detective Braszczok was placed on modified duty after he came forward last Wednesday — three days after the episode — to say he had been present. His arrest will result in his suspension.

Another police detective has said that he, too, was among the motorcyclists on the highway during the ride, according to Philip E. Karasyk, a lawyer for the Detectives Endowment Association. That detective was already on modified duty stemming from an unrelated domestic dispute.

Late Tuesday, the police charged another motorcyclist in the assault. Clint Caldwell, 32, of Brooklyn, was charged with gang assault, assault and criminal mischief.

The chase and the beating of Mr. Lien received widespread attention after a video taken by one of the riders circulated online. It showed riders chasing the vehicle onto the streets of Upper Manhattan. That video ended just as one motorcyclist, later identified as Reginald Chance, 37, began smashing his helmet into the driver’s side window. But other videos soon emerged.

One challenge for the police and prosecutors has been identifying people in the multiple videos and photographs.

The assault followed a prolonged highway confrontation between the S.U.V. and a group of motorcyclists on a sunny Sunday afternoon.

In addition to Detective Braszczok, five other motorcyclists have been charged; the police are actively searching for others.

On Monday night, the police charged a 29-year-old Brooklyn motorcyclist, Craig Wright, with assault, gang assault and unlawful imprisonment. On Tuesday, prosecutors said at his arraignment that he had been identified from video as a rider wearing a black helmet with spikes and a sweatshirt with the number 13 on the back. According to the criminal complaint, Mr. Wright was seen stomping on Mr. Lien “at least twice” while he was lying on the ground. Mr. Wright was one of about five or six men who beat Mr. Lien after he was dragged from his S.U.V., prosecutors said.

Only minutes before the beating, Mr. Lien had been driving north on the highway with his wife and 2-year-old daughter shortly before 2 p.m. It was there that they met a large group of motorcyclists who had gathered for an unauthorized ride into Times Square that had been broken up by the police, the authorities said.

The riders, prosecutors said, were driving recklessly. Video captured by one of the motorcyclists showed one of them, Christopher Cruz, 28, riding directly in front of the Range Rover. Prosecutors said Mr. Cruz deliberately slowed his motorcycle, causing a collision that quickly spiraled into a major confrontation.

With the riders stopped in front, behind and on both sides of the vehicle, Mr. Lien sped away, striking riders and seriously injuring one, Edwin Mieses Jr. Mr. Lien’s wife, Rosalyn Ng, said in a statement released by their lawyers that the couple feared for their lives.

NEW YORK (WABC) -- The good Samaritan who intervened in the confrontation between a group of bikers and an SUV was honored Sunday in Washington Heights.

Sergio Consuegra was commended by State Senator Adriano Espaillat and community advocates.

Drawing on Consuegra's experience, Espaillat continued his call for measures to safeguard Upper Manhattan from what he called dangerous, out-of-control motorcyclist behavior.

Earlier in the week, Espaillat spoke out against what he labelled the "the Wild West of motorcycle riders."

Everything that happened around Sergio Consuegra last Sunday was all bad. Consuegra is pictured on an NYPD flyer seeking information, and standing over Alexian Lien with his arms extended.

On Thursday, the NYPD released the photo of the Good Samaritans who were key witnesses to the assault. They were on their way to church when they saw the angry group of bikers descending onto a black Range Rover with a flat tire in Washington Heights.

"At that moment, nobody's stepping in," says Consuegra.

Consuegra said he had no other choice but to jump in when he saw Rosalyn Ng being dragged out of the SUV by a big bikers, and says the young mother was told "you're going to get it, too".

"He grabbed the lady by her arms real loud," Consuegra adds.

A crowd then gathered and started yelling "Not the lady", so he stopped.

Consuegra then jumped in between the biker who was smashing Lien with his helmet, and it was all over.

"I felt tense. I felt that God was with me there," says Consuegra. "I said stop it, let it go. And then somehow one of them moved started moving and I said yeah this is enough now."

"At that moment I said oh I gotta do something, there's a famly in danger here," Consuegra added, "And they're gonna get killed, nobody intervened in this situation and nobody stepping in."

Consuegra says he wishes he could have done more.

A group of motorcyclists encircle Lien’s SUV.

Graphic video surfaced Tuesday showing a Manhattan father being dragged from his luxury SUV by a mob of bikers yelling profanities and demanding that the victim “get out!”

The 19-second clip shows Alexian Lien, 33, being pulled from his Range Rover by his head and thrown to the ground in the vicious Sept. 29 beatdown.

The new video was obtained by WABC Channel 7, which reported it came from a witness to the assault that capped a 4-mile chase on the Henry Hudson Parkway.

A screen grab of Lien as he’s being assaulted by a group of motorcyclists.

The footage shows a hole the size of a motorcycle helmet through the rear window of Lien’s black SUV, and both the vehicle’s passenger-side tires are flat. The camera zooms in on the driver’s side door just as bikers dragged Lien out in front of his terrified wife and 2-year-old daughter.

The tape cuts off just as Lien is being thrown on the ground. Police said the victim was punched and kicked repeatedly before a good Samaritan intervened and stopped the attack.

Police respond to the vicious Sept. 29 assault, which capped a 4-mile chase.

The video was aired Tuesday as cops announced the arrest of another motorcyclist for the barbarous attack.

Jason Brown, 40, of Brooklyn is the ninth biker charged in the case.

He was slapped Monday with gang assault and felony assault charges for his alleged role in the shocking outburst of violence.

Alexian Lien was pulled from his SUV on the Henry Hudson Parkway on Sept. 29 and beaten.

Brown, who lives in Bushwick, has 18 prior arrests dating back to 1989 for drug and weapons offenses, among other crimes, a police source said.
The frenzied assault gained worldwide attention after earlier video of the chase and mob beating in Washington Heights, shot by a motorcyclist’s helmet cam, went viral.

Alexian Lien ran over motorcyclist Edwin Mieses, who will likely never walk again. Lien said he fled afterward because he feared for his life and that of his family.

Lien was chased off the parkway after he first bumped one biker and ran over a second, Edwin Mieses, who will likely never walk again.

Lien has told authorities he sped away because he feared for his life, as well as for his wife and child.

One of the previously arrested bikers is undercover NYPD Detective Wojciech Braszczok, who was off duty during the attack. He was due to testify before a grand jury Tuesday, but his lawyer said Monday that he and Braszczok, 32, had changed their mind.

The lawyer, John Arlia, said the detective should not have been charged with assault and that the only reason why he chased the SUV was that he had witnessed what happened to Mieses and didn’t want Lien to get away.

The only downside to that RR is the window smashing to easily and not killing any of the bikers.

If It was a reinforced, top of the line RR it would have been squish squish for the bikers. Bunch of punk ass fucks.

I suspect he'll be playing the motorbike game a lot in prison. It involves being ridden around the prison wing, and occasionally having his 'exhaust pipe' cleaned with a spit-covered cock.
